These General Terms and Conditions of Use (hereinafter, 'Terms') govern the access and use of the website www.axisenergia.com (hereinafter, the 'Website'), owned by AXIS ENERGIA S.L. Access to and navigation of the Website, as well as the use of its services and content, confers the status of user (hereinafter, the 'User') and implies full and unreserved acceptance of each and every one of these Terms in the version published at the time the User accesses the Website. Therefore, if the User does not agree with any of the Terms set forth herein, they must refrain from accessing and/or using the services and/or content made available to them on the Website. AXIS ENERGIA S.L. reserves the right to modify at any time the presentation, configuration and content of the Website, as well as the conditions required for its access and/or use. Access to the Website by the User is free of charge, without prejudice to the cost of connection through the telecommunications network provided by the access provider hired by the User.

Through the Website, AXIS ENERGIA S.L. provides Users with corporate information about the company and the services it provides in the field of photovoltaic solar energy, including: energy consulting and audits, design and installation of self-consumption photovoltaic systems, installation maintenance and optimization, processing of permits and legalizations, advice on grants and public aid, and personalized quotes. All services are subject to availability and may be modified, suspended or discontinued without prior notice. The quotes and quotations provided are for informational purposes, valid for 30 calendar days from issuance, and are subject to confirmation through the formalization of the corresponding service contract. Prices indicated in quotes do not include VAT or other applicable taxes, unless expressly stated otherwise.

3. User Obligations and Responsibilities

The User agrees to make appropriate and lawful use of the Website and its contents, in accordance with applicable legislation, these Terms, morality, good customs and public order. The User undertakes not to use the Website or the services offered for illicit purposes or effects, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload or impair the Website or prevent its normal use by other Users. Failure to comply with any of the obligations established in these Terms may result in the adoption by AXIS ENERGIA S.L. of measures deemed appropriate, including immediate suspension of services provided to the User and notification to the competent authorities.

4. Intellectual and Industrial Property

All contents of the Website, understanding by these merely by way of example and not limitation texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound contents, as well as their graphic design and source codes (hereinafter, the 'Contents'), are intellectual property of AXIS ENERGIA S.L. or third parties, without any of the exploitation rights recognized by current regulations on intellectual property being understood as transferred to the User. Trademarks, trade names or distinctive signs are owned by AXIS ENERGIA S.L. or third parties, without it being understood that access to the Website confers any right over said trademarks, trade names and/or distinctive signs. The reproduction, distribution, public communication, making available, transformation, in whole or in part, free of charge or for a fee, of any of the Contents, in any medium and by any technical means, without the express written authorization of AXIS ENERGIA S.L., is expressly prohibited. The User agrees to respect the Intellectual and Industrial Property rights owned by AXIS ENERGIA S.L. and third parties. The User may view and, where appropriate, download the Contents of the Website only for personal and private use, being prohibited their use for commercial purposes, their distribution, as well as their modification, alteration or decompilation.

5. Exclusion of Warranties and Liability

Energy saving estimates, return on investment, electricity production and any other economic or technical projection provided by AXIS ENERGIA S.L. are merely indicative and informative, and may vary depending on multiple factors such as geographic location, panel orientation and inclination, shading, weather conditions, installation conservation status, user consumption patterns and evolution of electricity prices, among others. Therefore, AXIS ENERGIA S.L. does not guarantee that estimated values will be achieved and assumes no responsibility for deviations that may occur. Notwithstanding the foregoing, AXIS ENERGIA S.L. declares that it has adopted all necessary measures, within its possibilities and the state of technology, to guarantee the operation of the Website and avoid the existence and transmission of viruses and other harmful components.

6. Applicable Law and Jurisdiction

These Terms are governed and interpreted in accordance with Spanish laws. For the resolution of any controversy or conflict that may arise from access to or use of the Website, AXIS ENERGIA S.L. and the User, with express waiver of any other jurisdiction that may correspond to them, submit to the courts and tribunals of the User's domicile if they have the consideration of consumer according to applicable regulations. Otherwise, both parties expressly submit to the courts and tribunals of Cádiz (registered office of Axis Energia). The applicable language will be Spanish.
